Este contrato de licencia de usuario final (en adelante denominado el “EULA”) constituye un acuerdo legal y vinculante entre PDF Pro Software Ltd., con domicilio social en 1383 W 8th Ave, Vancouver, BC V6H 3V9, Canadá, número de registro comercial 700468291BC0001, incluidas sus subsidiarias, afiliadas y contratistas que actúen en su nombre (en adelante denominados colectivamente “PDF Pro”, “Nosotros”, “Nos” o “Nuestro”) y cualquier persona o entidad y sus herederos, agentes, sucesores y cesionarios que hayan comprado o estén autorizados a acceder a nuestro software PDF Pro (en adelante denominados singular y colectivamente “Usted” o “Su”).

SECCIÓN 1 – FUENTES, ACCESO, ENTREGA Y REQUISITOS

1.1 Desktop Software License. Subject to your Subscription Plan, you are granted a limited, worldwide, non-assignable, and non-exclusive license to use the PDF Pro desktop software downloaded specifically from pdfpro.com.

1.2 Platform-Specific Builds. You acknowledge that PDF Pro maintains separate, distinct software builds for Windows and macOS operating systems. Your license grants you access to the specific build compatible with your purchased plan. A license for one platform does not inherently grant access to the other unless expressly provided in your Subscription Plan.

2.2) Dispositivos permitidos. Se le permite acceder y utilizar el software PDF Pro únicamente si ejecuta la cantidad de dispositivos (y/o usuarios autorizados, en el caso de una cuenta multiusuario) que permita el plan de suscripción correspondiente. A menos que se especifique lo contrario, la cantidad máxima de dispositivos permitidos por usuario (y/o por usuario autorizado, en el caso de una cuenta multiusuario) es de dos (2).

SECCIÓN 2 – DERECHOS CONCEDIDOS

You shall not, and shall not permit others to: Reverse Engineer: Decompile, disassemble, or attempt to derive the source code of the software. Redistribute: Rent, lease, sell, or sublicense the software to any third party. Compete: Use the software to build or support products competing with PDF Pro. Remove Notices: Alter or remove any identification markings or copyright notices.

SECCIÓN 3 – SUS RESPONSABILIDADES

3.1 Third-Party Notices. The software may include third-party components. Comprehensive notices, credits, and additional license terms for third-party software are accessible directly within the desktop application via the "About PDF Pro" popup.

3.2 System Requirements. The software is only eligible for support when running on the hardware and operating system environments specified in the official PDF Pro documentation. You are responsible for any hardware updates or third-party fees required to maintain compatibility.

Notice on Modernization: Over time, PDF Pro may lose compatibility with older computer systems in order to continue adding new functionality, modernizing its offerings, and maintaining security. We disclaim any liability in case updates result in an unavailability or incompatibility with older hardware or pre-existing third-party software.

4. AUTOMATIC UPDATES & AVAILABILITY

4.1 Maintenance Updates. The software may contain automatic update technology to provide bug fixes, patches, and new versions. By installing the software, you consent to the automatic downloading and installation of these maintenance features.

4.2 Discontinuation. We reserve the right to discontinue specific features or technical support in accordance with our discontinuation policy.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, PDF Pro shall not be liable for any indirect, incidental, or consequential damages arising from the use of the software. In no event shall our aggregate liability exceed the fees actually paid for your Subscription Plan during the twelve (12) month period preceding the date the claim arose.

6. INDEMNIFICATION

3.5) Indemnización. En caso de cualquier reclamación de un tercero que surja de una violación de sus obligaciones en virtud de esta Sección 3 (Sus responsabilidades), se aplicarán las Secciones 9.1) y 9.2) a continuación, además de cualquier otro derecho o recurso que se nos otorgue en virtud de este EULA y/o de acuerdo con la Ley aplicable.

7. GOVERNING LAW AND JURISDICTION

7.1 Governing Law. This EULA is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

7.2 Exclusive Jurisdiction. Any dispute arising out of this EULA shall be submitted to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.

8. AMENDMENTS

10.7) Enmiendas. La fecha de entrada en vigor de la última versión de este EULA se encuentra escrita arriba, tal como se publica de vez en cuando en nuestro sitio web en EULA. Tenemos el derecho de enmendar este EULA en cualquier momento, y de cambiar, eliminar, discontinuar o imponer condiciones sobre el uso del Software PDF Pro, en cuyo caso los nuevos términos y condiciones reemplazarán los términos anteriores. Cualquier cambio entrará en vigor después de treinta (30) días desde el momento en que le notifiquemos por primera vez sobre dichos cambios por correo electrónico o/y notificaciones mientras usa el Software PDF Pro y/u otros medios razonables. Su uso continuo del Software PDF Pro después de los cambios a este EULA después de la fecha de entrada en vigor de una versión revisada del mismo constituye Su aceptación expresa de, y acuerdo de estar sujeto a, este EULA vigente en ese momento. Si no acepta el EULA modificado en parte o en su totalidad, debe cancelar Su cuenta y dejar de usar el Software PDF Pro antes de que el cambio entre en vigor.
