Deze eindgebruikerslicentieovereenkomst (hierna te noemen de "EULA") vormt een wettelijke en bindende overeenkomst tussen PDF Pro Software Ltd., met statutaire zetel te 1383 W 8th Ave, Vancouver, BC V6H 3V9, Canada, bedrijfsregistratienummer 700468291BC0001, inclusief haar dochterondernemingen, filialen en contractanten die namens haar handelen (hierna gezamenlijk te noemen "PDF Pro", "Ons", "Wij" of "Onze") en elke persoon of entiteit en haar erfgenamen, agenten, opvolgers en rechtverkrijgenden die onze PDF Pro-software hebben gekocht of geautoriseerd zijn om toegang te krijgen tot onze PDF Pro-software (hierna afzonderlijk en gezamenlijk te noemen "U" of "Uw")

SECTIE 1 – BRONNEN, TOEGANG, LEVERING EN VEREISTEN

1.1 Desktop Software License. Subject to your Subscription Plan, you are granted a limited, worldwide, non-assignable, and non-exclusive license to use the PDF Pro desktop software downloaded specifically from pdfpro.com.

1.2 Platform-Specific Builds. You acknowledge that PDF Pro maintains separate, distinct software builds for Windows and macOS operating systems. Your license grants you access to the specific build compatible with your purchased plan. A license for one platform does not inherently grant access to the other unless expressly provided in your Subscription Plan.

2.2) Toegestane apparaten. U mag de PDF Pro Software alleen openen en gebruiken door het aantal apparaten (en/of geautoriseerde gebruikers, in het geval van een multi-user account) uit te voeren dat is toegestaan door het relevante abonnementsplan. Tenzij anders gespecificeerd, is het maximale aantal apparaten dat per gebruiker (en/of per geautoriseerde gebruiker, in het geval van een multi-user account) is toegestaan, twee (2).

SECTIE 2 – VERLEENDE RECHTEN

You shall not, and shall not permit others to: Reverse Engineer: Decompile, disassemble, or attempt to derive the source code of the software. Redistribute: Rent, lease, sell, or sublicense the software to any third party. Compete: Use the software to build or support products competing with PDF Pro. Remove Notices: Alter or remove any identification markings or copyright notices.

SECTIE 3 – UW VERANTWOORDELIJKHEDEN

3.1 Third-Party Notices. The software may include third-party components. Comprehensive notices, credits, and additional license terms for third-party software are accessible directly within the desktop application via the "About PDF Pro" popup.

3.2 System Requirements. The software is only eligible for support when running on the hardware and operating system environments specified in the official PDF Pro documentation. You are responsible for any hardware updates or third-party fees required to maintain compatibility.

Notice on Modernization: Over time, PDF Pro may lose compatibility with older computer systems in order to continue adding new functionality, modernizing its offerings, and maintaining security. We disclaim any liability in case updates result in an unavailability or incompatibility with older hardware or pre-existing third-party software.

4. AUTOMATIC UPDATES & AVAILABILITY

4.1 Maintenance Updates. The software may contain automatic update technology to provide bug fixes, patches, and new versions. By installing the software, you consent to the automatic downloading and installation of these maintenance features.

4.2 Discontinuation. We reserve the right to discontinue specific features or technical support in accordance with our discontinuation policy.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law, PDF Pro shall not be liable for any indirect, incidental, or consequential damages arising from the use of the software. In no event shall our aggregate liability exceed the fees actually paid for your Subscription Plan during the twelve (12) month period preceding the date the claim arose.

6. INDEMNIFICATION

3.5) Schadeloosstelling. Op elke claim van een derde partij die voortvloeit uit een schending van Uw verplichtingen onder deze Sectie 3 (Uw Verantwoordelijkheden), zijn Secties 9.1) en 9.2) hieronder van toepassing, naast alle andere rechten of rechtsmiddelen die Ons worden verleend onder deze EULA en/of overeenkomstig de toepasselijke Wet.

7. GOVERNING LAW AND JURISDICTION

7.1 Governing Law. This EULA is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

7.2 Exclusive Jurisdiction. Any dispute arising out of this EULA shall be submitted to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.

8. AMENDMENTS

10.7) Wijzigingen. De ingangsdatum van de laatste versie van deze EULA staat hierboven vermeld, zoals van tijd tot tijd gepubliceerd op onze website op EULA. Wij hebben het recht om deze EULA op elk gewenst moment te wijzigen en om het gebruik van de PDF Pro-software te wijzigen, te verwijderen, stop te zetten of voorwaarden op te leggen, in welk geval de nieuwe voorwaarden de eerdere voorwaarden vervangen. Alle wijzigingen worden van kracht na dertig (30) dagen vanaf het moment dat wij u voor het eerst op de hoogte stellen van dergelijke wijzigingen via e-mail of/en meldingen tijdens het gebruik van de PDF Pro-software en/of andere redelijke middelen. Uw voortdurende gebruik van de PDF Pro-software na wijzigingen in deze EULA na de ingangsdatum van een herziene versie daarvan vormt uw uitdrukkelijke aanvaarding van en instemming om gebonden te zijn aan deze EULA zoals die van tijd tot tijd van kracht is. Als u de gewijzigde EULA niet gedeeltelijk of volledig accepteert, moet u uw account beëindigen en stoppen met het gebruik van de PDF Pro-software voordat de wijziging van kracht wordt.
